Bechtel Infrastructure, along with key sub-vendors Bantrel and Comtech, has been appointed as the Delivery Partner (DP) within an Integrated Project Team (IPT) comprising the customer, Metrolinx, and its Technical Authority (TA) for the Ontario Line Subway (OLS) Project. The OLS Project scope includes the design build, operation, and maintenance of all infrastructure and rail systems associated with 15 stations and over 15km of new alignment, being delivered through major Public Private Partnership (P3) contracts and multiple Early and Advanced Works (EAW) contracts. The OLS Project is planned to open for revenue service in 2031. DP forms a key part of the overall leadership of the OLS Project.

Job Description

The Contracts Commercial Lead - North Civil manages the North Works contracts operations to ensure the effective administration of contracts. Responsible for implementation of Metrolinx standard work process and procedures. Provides operational supervision and technical guidance to Site Contract Administrator(s). Reports directly to the North Manager. Receives functional guidance from the responsible Contracts Manager. The Contracts Commercial Lead - North Civil has the following additional responsibilities:

  • Deputizes for the North Manager
  • Leads the North Works project controls, risk, reporting, and document control teams.

Job Responsibilities:

  • Analyze the contract terms and conditions to become fluent with the obligations of the contractors and the ITP, and contract processes. Highlight areas of risk such as ambiguities, conflicts or deviations from the scope of work. As work proceeds, make recommendations to the North Manager on the mitigation of these risks; closely monitor and support remedial actions and recommend appropriate tradeoffs.
  • Responsible for the development and management of appropriate mechanisms to monitor the contractors’ compliance with contracts terms and conditions.
  • Responsible for working with the other project team members to ensure that Delivery Partner or customer related actions or inactions which could result in constructive contract changes are identified and make recommendations on their resolution.
  • Responsible for the management of the procedure to recognize and identify contract claims as they develop and manage the timely resolution under the changes provisions wherever possible, obtaining claims and legal expertise as appropriate.
  • Maintain a working relationship with construction, engineering, procurement, legal and risk management throughout the Integrated Project Team (IPT) to facilitate organizational interfaces between those performing contract administration.
  • Provide North Manager with reviews and analysis of the contractors’ performance against the contract including conformance, schedule and financial data.
  • Participate in commercial contractual negotiations and provide guidance to North Manager.
  • Supervise cross functional team comprising project controls, risk, reporting, and document management.
  • Establish and maintain a positive relationship with the contractors.
  • Undertake reviews of contract documents prior to issuance to market to identify potential inconsistencies and reduce MX exposure to claims
  • Provide guidance to North Manager on budget positions and projected forecasts

Qualifications

Job Qualifications:

 

  • Degree in Business, Quantity Surveying, Supply Chain Management, Law, Engineering, Construction Management or Cost Engineering desirable, or other industry related field along with 15+ years of experience.
  • Experience and courses in pricing, contract law, contract drafting, administration and negotiation of change orders, effective correspondence, planning and scheduling.
  • Thorough knowledge of contract administration, procedures and documents relating to a multi-discipline construction project. Experience managing contracts in Canada preferred.
  • Experience of complex rail mega-projects in urban areas desirable.
  • Direct experience in the function of managing workload distribution and execution of the work.
  • Working knowledge of engineering/construction industry contracting practices, applicable government and commercial regulations and practices. Experience with Metrolinx policies, procedures, and work practices desirable.
  • Working knowledge of automated contract management systems.
