Job Description

In this full time permanent role, you will be a champion of diversity and inclusion.

The Contracts Commercial Lead – South Civil is responsible for safeguarding that the Project Company (PCo) is discharging its delivery obligations in accordance with the contract. Note: The DP is working alongside the TA which is responsible for technical (design) compliance with the Output Specification. The Contracts Commercial Lead – South Civil is also responsible for the DP’s processes, procedures and tools for monitoring PCo performance and contract progress.

The South Civil contract is for the construction of 7km of twin-bored tunnels running east-west under downtown Toronto, one surface station (Exhibition) and six underground stations.

The Contracts Commercial Lead – South Civil reports to the South Manager and shall deputize for the South Manager as required. The Contracts Commercial Lead – South Civil has a team (at peak) comprising two contract coordinators, three planners, risk analyst, reporting analyst and two document coordinators.

 Duties & Responsibilities include:

  • Becoming fluent with the South Civil P3 contract, specifically the obligations of the PCo and the CA (excluding technical (design) obligations of the Output Specification). Highlighting ambiguities, conflicts or gaps in the contract. Developing and delivering targeted training (commercial awareness) on the contract to the DP team.
  • Establishing and managing a system / tool for tracking and reporting on the PCo’s and CA’s compliance with the contract.
  • Monitoring the planning and discharge of contract obligations (e.g. contract deliverables) by the PCo and the CA and recommending actions to address contract non-conformances / improve the outcome of the OL.
  • Identifying health, safety, environment, quality, interfaces, schedule and cost risks associated with the discharge of the PCo’s and CA obligations for South Civil contract.
  • Recommending actions to mitigate the impact of emerging issues during the planning and discharge of the PCo’s contract obligations and following up.
  • In coordination with the Independent Certifier (IC) managing processes for tracking and reporting on contract payments, variations and disputes. Managing the timely processing and resolution of variations, obtaining expertise (including claims and legal) as appropriate.
  • Reporting PCo and CA contract compliance status. Performing financial analysis and reporting financial data and escalating issues to the South Manager.
  • Participating in commercial contractual negotiations and provide guidance to South Manager.
  • Engaging with the DP South Civil team on contract & procurement, project controls, risk and document management issues and providing direction and feedback.
  • Establish and maintain a relationship with PCo equivalent(s).
  • Maintaining a “look-ahead” view and assessing commercial and contract obligation forecasts, risks and issues.
  • Preparing / reviewing input to DP South Civil progress report for the PCo’s and CA’s compliance with the contract.
  • Providing contracts subject matter expertise (e.g. contract interpretation) to the DP South Civil team.
  • Maintaining a relationship with the IPT contracts team. Providing feedback to, and sharing relevant information received from, the IPT contracts team with the South Civil team.

Qualifications

  • Relevant bachelor’s degree from an accredited university. Guideline: 15-20 years of relevant work experience.
  • Previously held commercial management position(s) on projects of similar scope, size and complexity to a significant portion of a metro project. Experience of metro / rail projects in urban areas is desirable.
  • Experience in pricing, contract law, contract drafting, administration and negotiation of variations and contractual correspondence. Experience of contract administration in Canada is desirable.
  • Working knowledge of project controls for infrastructure projects including planning, schedule, cost, risk and reporting. Working knowledge of other project functions (e.g. engineering, construction) is desirable.
  • Strong leadership, relationship building and communication skills (verbal and written).
  • Fluent in using Microsoft Word, Excel and PowerPoint. Experience of using automated contract management systems (e.g. Unifier).
