Job Description

To provide a strategic and operational support with respect to the law governing the Payment System in Brazil that meet regulatory and strategic compliance objectives of Visa Inc. and its Clients with respect to the Visa do Brasil Politicas, Visa International By-Laws, Visa Core Rules & Product and Service Rules and associated Supplemental manuals. Combined this required documentation of the law is now called the "Visa Brasil Regulamento".

The role is primarily accountable for support with the Visa Brasil Regulamento in Brazil, interaction with the Central Bank of Brazil addressing all inquiries and addressing all potential violations and all other aspects of the Visa Rules including requesting approval of the central Bank for rule changes and notifying them of other changes. The jobholder will ensure that Clients are compliant to the regulations and to monitor, investigate and validate the compliance status of Clients and where necessary to pursue corrective, and negotiated action, with the Clients to bring them into compliance following the regulations as appropriate.

  • Managing and publishing the Visa Brazil Regulamento which incorporates (Visa International By-laws, Visa Brasil Politicas, Visa Ore Rules and Product and Service Rules redacted for Brazil and various Visa Supplemental documents
  • Managing the translation process with the document owners twice a year or as needed; as well as the Visa Rules and all associated processes and procedures
  • Managing the publication of the Visa Brasil Regulamento for clients and in addition a redacted version for public disclosure. Determining what aspects should be redacted for the Public version under the team's criteria will need to addressed and decisions made
  • Managing the Translation vendor relationship. Ensuring project plan are followed to meet publication dates in April and October
  • Managing the communication (notification/approval) with the Central Bank of Brazil in Portuguese of all changes to the Regulamento, as defined, and to gather pre-approval of all Brazil policy and procedures as required by law
  • Reviewing all changes to the Regulamento, Risk Assessment, NBIA, and Visa Business News for potential impacts to Brazil and the Regulamento
  • Provisioning of technical leadership to other Visa staff on the Visa Brasil Regulamento
  • Assisting in the development of New and Revised Visa Rules, Visa Regulamento and Waivers as need it
  • Assisting in maintaining the relationship with appropriate government entities in Brazil; primarily BACEN (the Central Bank)
  • Supporting internal teams (Government Relations and Legal, amongst others) as it relates to Brazil Payment System requirements
  • Supporting the development of departmental procedures, development and maintenance
  • Ensuring that Clients are compliant to the regulations and to monitor, investigate and validate the compliance status of Clients and where necessary to pursue corrective, and negotiated action, with the Clients to bring them into compliance following the regulations as appropriate
  • Managing internal and external relations within the context of compliance enforcement (non-compliance assessments) and processes escalating where appropriate to the Visa Rules Management senior management with the intention of ensuring minimal brand and reputational risk exposure to the Visa Inc. enterprise
  • General Client compliance with the Visa Brasil Regulamento, Visa International By-Laws, Visa Core Rules and Product & Service Rules covering:
  • Assessment of the severity of the violation
  • Management of the resolution, including:
  • Assessment of fines/penalties;
  • Implementation of variances / waivers in conjunction with Visa Rules Management Development staff;
  • Updates to compliance parameters/business rules;
  • Communication with Clients, Government Relations, Sales, Risk and business rule owner
  • Participating in the development and execution of activities and programs aimed at improving Client and/or internal satisfaction

The role will also manage internal and external relations within the context of compliance negotiations and enforcement (non-compliance assessments) and processes escalating where appropriate to the Visa Rules Management senior management with the intention of ensuring minimal brand and reputational risk exposure to the Visa Inc. enterprise. The function will operate with senior Visa Inc. staff and Local and Regional Management Committee's as well as senior level officers of Clients to facilitate compliance with the Visa Brasil Regulamento and / or impose non-compliance assessments to incent compliance. The role will manage and ensure that non-compliance assessments are assessed, deferrals granted when appropriate or waivers granted per the agreed upon processes.

To also provide Clients and staff with accurate interpretation and analysis of the Visa Brasil Regulamento in response to telephone or written inquiries and / or proposed Client or Merchant activities, and as a full project team member for assigned projects as required.

Qualifications

  • Bachelor's Degree
  • 7 - 10 Years Prior Experience
  • Portuguese a MUST
  • Excellent interpersonal, lobbying and communication skills (written and verbal)
  • Ability to effectively work under pressure, be proactive and self-challenging when dealing with challenging compliance issues
  • Established knowledge of general auditing and compliance procedures and functions
  • Demonstrated knowledge and ability to evaluate business compliance and adherence to relevant standards, rationale judgements and recommendations in carrying out compliance activity
  • Proven negotiation skills to manage internal and external parties and in the implementation of compliance actions in accordance with the procedures laid out in the By-Laws, Visa Rules, and Visa Brasil Regulamento
  • Excellent presentation skills, high personal impact and confidence to communicate and influence
  • Excellent administrative and self-management skills including clear and demonstrable planning, tracking and organisation
  • High level of self-motivation, good judgment, diplomacy and tact, with the ability to work with staff at all levels of seniority throughout the organization
  • Good presentation skills accompanied by high personal impact and confidence to communicate and influence across all levels of the Visa Inc. organization and with Members
  • Proven project management skills to co-ordinate divergent interests, commensurate with managing a multi-faceted compliance programme at an international level
  • Understanding of Visa products, services and systems
  • High level of self-motivation, good judgement, diplomacy and tact

  • Knowledgeable of different payment markets and with the ability to travel
